OVERVIEW — Welcome to Blaze Works Co.! "We", "us" and "our" refer to Blaze Works Co. By visiting, interacting with, or using our store, website, and services (the "Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Services. Please read carefully — these Terms include important information about your legal rights, including warranty disclaimers, assumption of risk, and limitations of liability.

SECTION 1 — ACCESS, ACCOUNT & AGE (18+) — You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to purchase. By placing an order you confirm that you are 18 or older and are buying for lawful use only; we do not knowingly sell to minors. You represent that all information you provide is correct and that you are responsible for your account security and activity. You may not transfer, sell, or assign your account.

SECTION 2 — NATURE OF THE PRODUCT & INTENDED USE — The Blaze Works Torch Gun is a propane-powered blow torch / cooking torch intended for lawful outdoor and utility uses such as BBQ, searing, lighting charcoal and campfires, melting ice, burning weeds, and small welding/soldering jobs. It is a tool — NOT a weapon and NOT a toy. Propane fuel is not included and is sold separately. You are responsible for confirming the product is legal in your location before purchase.

SECTION 3 — ASSUMPTION OF RISK & RELEASE — You understand this product produces an intense open flame and extreme heat and is inherently dangerous if misused. You voluntarily assume all risk arising from its purchase, possession, storage, and use. To the fullest extent permitted by law, you release and hold harmless Blaze Works Co., its owners, employees, and affiliates from any and all liability for injury, death, fire, or property damage resulting from the use or misuse of the product. You are solely responsible for using it safely, lawfully, and per the included safety instructions.

SECTION 4 — SAFE & LAWFUL USE — You agree to follow all included safety and propane-handling instructions, keep the product away from children and pets, use it only outdoors or in well-ventilated areas, and never aim it at people, animals, structures, or vehicles. You will comply with all applicable laws.

SECTION 5 — OUR PRODUCTS — We make every effort to represent products accurately, but colors/appearance may differ on your screen. We do not warrant that appearance or quality will meet your expectations. Descriptions may change at any time, and we may discontinue products or limit quantities.

SECTION 6 — ORDERS — Placing an order is an offer to purchase. We may accept or decline any order at our discretion; your order is not accepted until we confirm it. Orders are subject to our Refund Policy. Purchases are for personal use only.

SECTION 7 — PRICES & BILLING — Prices, discounts, and promotions may change without notice and do not include taxes, shipping, handling, or customs charges. You warrant the payment information you provide is accurate and that you are authorized to use it.

SECTION 8 — SHIPPING & DELIVERY — We are not liable for shipping or delivery delays. Delivery times are estimates only. Once products are handed to the carrier, title and risk of loss pass to you.

SECTION 9 — COMPLIANCE & SHIPPING RESTRICTIONS — We ship only to permitted destinations and do not ship where the product is restricted. You are responsible for ensuring the product is lawful in your location.

SECTION 10 — INTELLECTUAL PROPERTY — Our trademarks, brand, text, images, video, and designs are owned by Blaze Works Co., its affiliates, or licensors. You may use the Services for personal, non-commercial purposes only and may not use our trademarks without written permission.

SECTION 11 — OPTIONAL TOOLS / THIRD-PARTY LINKS — Third-party tools and linked sites are provided "as is" and at your own risk; we are not responsible for their content or policies.

SECTION 12 — RELATIONSHIP WITH SHOPIFY — Our store is powered by Shopify. All sales are made directly with Blaze Works Co.; Shopify is not responsible for your purchases. Certain data is shared with Shopify per our Privacy Policy.

SECTION 13 — FEEDBACK — By submitting feedback, you grant us a perpetual, worldwide, royalty-free license to use it, and represent you have the rights to it.

SECTION 14 — ERRORS & PROHIBITED USES — We may correct errors and cancel orders if information is inaccurate. You may use the Services for lawful purposes only and not for any illegal, harmful, or malicious purpose.

SECTION 15 — TERMINATION — We may terminate your access at any time. Provisions that should survive (including Sections 3, 16, 17) survive termination.

SECTION 16 — DISCLAIMER OF WARRANTIES — THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

SECTION 17 — LIMITATION OF LIABILITY — To the maximum extent permitted by law, Blaze Works Co.'s total liability for any claim shall not exceed the amount you paid for the product. We are not liable for any indirect, incidental, special, consequential, or punitive damages.

SECTION 18 — INDEMNIFICATION — You agree to indemnify and hold harmless Blaze Works Co., Shopify, and our affiliates from any claims, damages, or expenses (including legal fees) arising from your use or misuse of the product or your breach of these Terms or any law.

SECTION 19 — GOVERNING LAW & DISPUTE RESOLUTION — These Terms are governed by the laws of the United States and the state in which Blaze Works Co. is organized, without regard to conflict-of-laws rules. Any dispute shall be resolved by binding arbitration on an individual basis, and you waive any right to participate in a class action. Where arbitration is unavailable, disputes shall be brought exclusively in the courts of Blaze Works Co.'s home jurisdiction.

SECTION 20 — GENERAL — If any provision is invalid, the rest remains enforceable. Failure to enforce a provision is not a waiver. These Terms are the entire agreement. You may not assign them without our consent; we may assign without consent. Headings are for convenience only. We may update these Terms by posting changes; continued use constitutes acceptance.
